BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />File No. C-84-065 <br />JOINT REQUEST TO CONTINUE HEARING <br />NEW CASTLE ENERGY CORPORATION, PERMIT REVISION NO. 1 <br />The Mined Land Reclamation Division ("Division"), the New <br />Castle Energy Corporation ("NCEC"), and the Garfield Citizens' <br />Alliance ("GCA") jointly request the Mined Land Reclamation Board <br />to continue the hearing on NCEC's appeal of the Division's pro- <br />posed decision concerning NCEC's permit revision to the December <br />Board meeting. As grounds, the parties state as follows: <br />1. On October 19, 1990 the Division issued its proposed deci- <br />sion on NCEC's permit revision. <br />2. On October 23, 1990 the Division published a notice of its <br />decision in a newspaper of general circulation as required <br />by rule 2.07.4(2)(d). On the same day NCEC filed a request <br />for a hearing before the Hoard on the proposed decision. <br />3. Section 34-33-119(5), C.R.S. (1984) and rule 2.07.4(3)(b) <br />require the Board to hold the hearing by November 23, 1990. <br />However, §34-33-119(4), C.R.S. and rule 2.07.4(3)(a) allow <br />any interested person to appeal the proposed decision, pro- <br />vided such request is filed by November 23, 1990. Accord- <br />ingly, the rules require the Hoard to hold the hearing on <br />NCEC's appeal before the time allowed for other interested <br />parties to appeal has expired. <br />'~.~ 4.
