In addition, the Division suggests considerati~m be given <br />to constructing internal berms with large radius curves inst~aad of the <br />general straight lines currently proposed as depicted on Exhibit C-7. <br />The smaller undulations, on the order of 5 to 25 feet as desc:ribed in the <br />narrative, could be incorporated as well. The inclusion of r:urved <br />shorelines will add to the visual attractiveness of the area upon final <br />reclamation. <br />8. Upon review of the reclamation plan, it has been proposed th~rt Areas 1, 2 <br />and the backfilled portion of Area EI be considered as industrial areas <br />and, because of their historic and intended future uses as such, be <br />excluded from consideration for the purposes of assessing thE~ appropriate <br />financial warranty amount required for the amended permit. :ft has been <br />determined that these areas of disturbance must be warrantee<i. Although <br />the disturbance occurred prior to the enactment of the law in 1973, they <br />have been subsequently reaffected and continue as a functioned part of <br />the mining operation. These areas must be covered by financiia1 warranty <br />throughout the mining and reclamation period and may become suitable for <br />release after all other mined areas within the redefined pe rnrit area are <br />released. <br />In reviewing the bond calculation, the backfilled portion of Area EI has <br />been assigned an alternative designation as pond area and reclamation <br />costs for creating the shoreline in this location have been included. <br />The Division considers this appropriate and suggests a similar <br />procedure be used for Areas 1 and 2. Costs for ripping or chiseling, <br />topsoiling, and revegetation as appropriate should be provided in a <br />revised bond amount for consideration prior to amendment approval. <br />The Board is scheduled to consider the amendment proposal at <br />October 22, 1987 meeting date.
