<br />• <br />During the pre-operation inspection, the applicant stated that [he road west of [he Kupio Pit would <br />be mined through and relocated on the property. Unless Loukonen Brothers privately own [his <br />road, the applicant will need to provide written consent from the owner(s) of the road that it ntay <br />be relocated. In addition, the applicant will need to provide the Division a description of <br />construction methods for the relocated road including a location of the road, methods of <br />construction and a general reclamation plan. <br />Rule 6.4.6 Exhibit F- Reclamation Plan Map The applicant did not provide an adequate reclamation <br />plan ntap noting the expected physical appearance of the area of the affected land. A map will need <br />to be submitted depicting the proposed topography of the area including contour lines and sufficient <br />detail to portray the direction and rate of slope of all reclaimed lands. Maps must meet the general <br />map requirements noted in question # 3. <br />8. Rule 6.4.13 Exhibit M- Other Permits attd Licenses The applicant states that no other permits are <br />required. The applicant may need to apply for a County Special Use Pernit in Boulder County and <br />Larimer County. You should contact the Counties [o determine if special use permits are needed. <br />Please also be advised that you may need a Stormwater Permit from the Colorado Department of <br />Public Health and Environment, Water Quality Control Division. Ifany storm water control <br />structures are required to be constructed at the mine site as a result of the storm water permitting <br />process, [he operation and reclamation aspects of such structures must be included in [he Reclamation <br />Penn it. You should contact the Colorado Depart~ttent of Public Health and Environment to determine <br />if a storm water permit is needed. <br />The Division received letters from the Department of the Army and the Division of Wildlife (DOW). <br />The DOW recommends that the applicant check all trees that are to be removed and rocky cliff areas <br />to be mined for the presence of raptor nests prior to mining such areas. If nests are found, the <br />applicant will need to contact the DOW in order to minimize disturbance to [he wildlife and wildlife <br />habitat. Please include this language in the application. Copies of the letters are enclosed for your <br />files. <br />10. Exhibit N- Source of Legal Rieht to Enter & Exhibit O- Owners of Record of Affected Land and <br />Substance to be Mined <br />What is the legal right of entry to mine and reclaim in the northern portion of the Helsinki Quarry (in <br />Larimer County)? Please provide documentation that Loukonen Brothers has [Ite right to enter and <br />mine in that portion of the permit area. <br />Please be advised that the Beech Hill Quarries conversion application may be deemed inadequate, and the <br />application may be denied on August 12, 1999 unless the above mentioned adequacy review items are <br />addressed to the satisfaction of the Division. Any change from this date will need to be approved by the <br />MLRB.
