<br />MLRB at the next scheduled Board Hearing (July 27-28, 1999), however, it is no[ certain if the <br />Board will grant this request. This option should be considered if the area is no longer used by <br />the applicant, and reclamation can be performed at this point in time, OR <br />If [he disturbance fal Is within [he affected area boundary of the adjacent quarry, [he adjacent <br />operator may amend their application to include the disturbance. Upon approval of the amended <br />application, Loukonen Brothers may request a bond release from this disturbance. Approval of <br />the permit amendment (for the adjacent quarry) must coincide with the Division's decision due <br />date. This option should be considered if the adjacent property owner intends to continue mining <br />or using the area. <br />2. As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated in <br />the local newspaper and all owners of record of surface lands that are within 200 feet of the boundary <br />of the affected land. Proof of notice may be return receipts of a Certified Mailing or by proof of <br />personal service. <br />3. Rule 6.2.1(2) General Reouirements of Exhibits <br />The maps submitted by the applicant do not meet the general requirements of the Rules and <br />Regulations. All Maps and Exhibits (except the index map) must conform to the following criteria. <br />In particular the mining and reclamation plan maps must include the following; <br />• show the name of the applicant, <br />• must be prepared and signed by a registered land surveyor, professional engineer, or other <br />qualified person, <br />• give the date prepared, <br />• identify and outline the area which corresponds with the application, <br />• be prepared at a scale no larger than 1 inch = 50 feet nor smaller than linch = 660 feet, <br />• provide a map scale, appropriate legend, map title, date and north arrow. <br />4. Rule 6.4.3 Exhibit C- Pre-Minine and Minine Plan Mao(s) of Affected Lands The following items <br />need to be included in the application; <br />• Rule 6.4.3(a) requires that immediately adjacent surface owners be identified on a map. <br />Rule 6.4,3(6) requires a map be submitted identifying all creeks, roads, buildings, power and <br />communication lines on the area of the affected land and within 200 feet of all boundaries, if any <br />permanent man made structures are within 200 feet of the affected area, then the applicant will <br />need to meet the requirements noted in Rule 6.4.19. <br />• The applicant will need to provide the existing topography of the area, with contour lines in <br />sufficient detail to portray the direction and rate of slope of the affected land. <br />5. Rule 6.4.4 Exhibit D- Minine Plan Please address the following items in the mining plan; <br />• What is the nature, depth and thickness of the deposit to be mined for each quarry. Please also <br />identify the material immediately beneath the material to be mined. <br />Please state if additional overburden will be removed under the permit expansion, and where will <br />the material be stockpiled. <br />
