DEPARTMENT OFTHE ARMY
U.S. ARMY ENGINEER DISTRICT, SACRAMENTO
CORPS OF ENGINEERS
1325 J STREET
SACRAMENTO, CALIFORNIA 958142922
ATTENTION OF February 19, 2003
Regulatory Branch (200375045)
J.E. Stover & Associates
Mr. J. E. Stover
2768 Compass Drive, Suite 101
Grand Junction, Colorado 81506
Dear Mr. Stover:
We are responding to your written request dated January 29,
2003, on behalf of Louisiana Land and Gravel Company, for a
jurisdictional determination on a parcel located along Redvale
Road near the Town of Redvale, known as the Angie Pit. The
property is located within Section 10, Township 45 North, Range
14 West, Montrose County, Colorado.
Based on a site inspection by Mr. Nick Mezei of this office
on February 5, 2003, we determined that wetland jurisdictional
under Section 404 of the Clean Water Act does not exist on the
parcels labeled as Phase I, Phase II and Phase III on a map you
provided, titled Vegetation, Exhibit J-1. This verification
excludes three ponds shown on the subject maps within Phase II.
The wetland species noted on the map within Phase III contained
isolated units of saplings with upland understory grasses, and
therefore, this area does not qualify as a jurisdictional wetland
under Section 404 of the Clean Water Act.
This verification is valid for a period of five years from
the date of this letter and is based on information supplied by
you. If that information proves to be incorrect, we will adjust
our determination accordingly. We have assigned number 200375045
