MEMO <br />TO: Berhan Keffelew, Division of Minerals and Geology <br />FROM: Rob Laird, Land Manage <br />DATE: 22-12-02 <br />RE: Agreement with Urban Drainage and Flood Control District (UD&FCD) for <br />Speer Mining Resource Amendment, M-1983-176 (AM-2) <br />CC: File, Bryan Kohlenberg (UD&FCD) <br />Berhan: <br />Per my commitment to you to further explain and qualify the agreement that will be in <br />place with UD&FCD prior to mining within a 100 ft. setback from the South Plate River <br />on the referenced amendment property, I offer the following explanation -and <br />commitment for you to include in your Adequacy Review: <br />Please see attached map of the area of the South Platte River for reference where the <br />Speer Mining Resource is located. This map, sheet 17 of 67 of the new South Platte <br />Master Drainage Plan by UD&FCD, was provided to me by Bryan Kohlenberg of <br />UD&FCD in August 2002 for preparation of this amendment. It is a reduced map from <br />their Master Plan. I have highlighted areas and descriptions where Asphalt Specialties <br />Co., Ina (ASCI) will perform river stabilization work for the right to mine closer to the <br />high-water bank of the river. <br />In summary, our amendment application to both the county and the state DMG, is a <br />continuation of the previous mining permit amendment submitted and approved in 2000 <br />(AM-1). In that application, ASCI was granted the right to mine to within 50 ft. of the <br />crest of the high-water bank on the east side of the Platte River, followed by backfilling <br />of that portion, during the low-flow period of October 1 through April 1, where the river <br />flowed away from the high-water (flood flow) bank. Where the river naturally flowed <br />adjacent to the high-water bank, the mining plan required a 100 fl. setback. In both cases, <br />riverside and pitside protection consisting of buried rip-rap'were/are to be placed. There <br />are only two short stretches of the riverbank in the north and south part of the original <br />amendment area that requires staying 100 ft. from the high-water bank.
