Bear Coal Company needs to describe how sixty oercent of the sediment <br />storage capacity will be determineG in the Bear No. 3 sediment pond per <br />Rule 4.05.6. <br />8. Section 4.09 of the permit application needs to he updated to reflect the <br />disposal of underground development waste at the mine site. The permit <br />application states that no underground development waste will be <br />generated. Bear Coal subsequently requested a Minor Revision to <br />temporarily store underyround development waste on the surface. This <br />waste material was to be r=turned to the e?i workings as the mine was <br />developed. Bear Coal Company is re^uested to discuss the disposal of <br />underground development waste at the mine. The ccntinuina disposal of <br />th?s material should also be discussed. <br />9. Bear Coal Company needs to address the issue of storage and disposal of <br />non-coai wastes at the Bear No. 3 Mine. Information regarding the <br />storage ono final disposal of snl;d waste and old machinery at the mine <br />that has been presented to the Division is inadequate. The permit does <br />not provide for disposal of non-coal wastes on site. The permit states <br />t`at solid waste aene••ated at the gear Mine is to be disposed of at the <br />Delta Cou~?ty landfill. Used ~i~ an/: grease is to he collected in tanks <br />on site and periodically sold to a local oil salvage dealer or disposed <br />of in the Delta County landfill. Numerous pikes of eld mining equipment <br />and combustible materials are Curren*':y <_cattered on the eastern par' of <br />the gear No. 3 disturbed area. These pieces of equipment aren't stored <br />in an orderly r!anner per Rule 4.11.4, The storage area is not designed <br />to centroi leact~ate migration into the underlying alluvial aquifer (Rule <br />4.11.4). <br />The Bear Coal Company is requested to present a comprefi~nsive nor,-coal <br />4rs!~e d sposal plan wh?ch :v!li r?salt !n the prcmpt ~'isposal Gr prroper <br />storage of non-coal wastes per P.~~le 4.11.4, The plan should discuss the <br />prompt removal cf all unnecessary non-coal waste and provide for an <br />orderly storage facility which is designed to eliminate surface and <br />ground water contaminat?cn. Information dAscribing the storage of <br />non-coal wastes at the mine shall be inserted in Section 4.11.4 of the <br />pErml t. <br />10. The Division has the following concerns regarding the planting of <br />seedlings at the Bear No. 1, No. 2 and No. 3 sites. The narrative of <br />Section 2.05.4 needs to be rewritten to address these following concerns: <br />A. Bear Coal Company is requested to submit a map indicating where it <br />intends to plant the various seedlings listed in Table 11, Seedling <br />Transplants. The narrative en page 2.05.41 discussing seedling <br />transplants should indicate the location and density of the seedling <br />transplants. <br />B. The seedling density for the Sear No. 1 and Bear No. 2 properties is <br />indicated at 400 stems/acre for hawthorne and willow. The willow <br />density for Bear No. 3 is 10 stems/acre and no hawthorne <br />transplanting is to take place. Rear Coal needs to address the <br />reduced planting density of willow seedlings and the lack of <br />hawthorne seedlings at the Bear No. 3 mine. <br />
