Lang <br />Division Dvetlor <br />RE: Whitewater Pit 500, Permit No. M-77-129, Amendment No. 2 Fifth Adequacy Review <br />Dear Mr. O'Brian: <br />The Division has reviewed your October 12, 1999 response to the third and fourth adequacy <br />reviews for Whitewater's Application for Amendment No. 2 to Permit No. M-77-129. Listed <br />below are adequacy issues that were not adequately addressed in your response. The comment <br />numbers for the third adequacy review remain the same as in the preliminary adequacy review. <br />The fourth adequacy review had a new numbering scheme and the Division's comments for that <br />review are numbered as they were in that review. <br />Responses to this review letter must be received by 3:00 P. M. today and must be adequate for <br />this amendment to be approved. If responses cannot be provided by that time, a request for <br />extension of the decision due date must be submitted by 3:00 P. M. today. If either the adequate <br />responses or an extension request are not received by the time specified, the Division will have no <br />choice, but to deny the application. <br />THIRD ADEQUACY REVIEW COMMENTS <br />1-12. Response acceptable. <br />13.The Division has concerns about the settling pond, with a finished water depth of two feet <br />and no inlet or outlet, becoming a stagnant, insect breeding area. A finished water depth of at <br />least six feet should be designated to minimize this potential condition. <br />14. Please submit documentation that indicates the date that the building code resolution was <br />implemented. This date, and the date the on-site buildings were erected, are needed to verify <br />that they qualify for the grandfather clause. <br />15-20.
