Long <br />Division D'ueclor <br />We have reviewed Powderhom Coal Company's response dated January 10, 2001, regarding Technical <br />Revision No. 35. Our remaining adequacy concerns are detailed below. Please provide adequate _ <br />responses to this letter by February 23, 2001. - <br />With regard to Virginia and West Virginia violations listed in permit Stipulation No. 23, and the <br />AML fee violation linked to PCC through Donn Chickering, these matters wilt be addressed through <br />other more appropriate proceedings, if necessary. These matters will not be linked [o Technical <br />Revision No. 35. <br />North Portal Facility area drainage plan concerns, detailed in sub-items a through c. <br />a) Exhibits 8C and 27 topographic map and cross-sections were appropriately amended. Table 14- L <br />1 should be updated to correspond to the amended exhibits. <br />b) Response acceptable. Item resolved. <br />c) Response acceptable. Item resolved. <br />Questions regarding the french drain system were adequately addressed by amended exhibits and // <br />text. The P.E. certification statement on amended Exhibit 26 was not stamped, signed and <br />dated, and this will need to be provided. <br />The Division is concerned that the french drains alone may not be adequate to collect all seepage <br />from within and about the portals, and there may be some residual threat to backfill stability. Due to <br />joint and fracture patterns in the strata in the portal vicinity, and potential variations within the <br />worked materials, seepage would be dispersed and random.
