The lessee did not conduc*, a <br />cultural resource intensive field inventory in a manner specified by <br />the authorized officer of the BLM (Section 30(a)). The lessee has not <br />contacted the Bureau of Lana Management to determine whether the <br />authorized officer will require the lessee to conduct a <br />paleontological appraisal of the mine plan and ad,)acent areas that ma.y <br />De adversely affected by lease-related activities (Section 30(b)). <br />The lessee of Federal coal tease C-0128433 has not met the <br />requirements of Section 14 (A) through the information contained in <br />this permit revision. The lessee did not conduct a survey acceptable <br />to the District Manager to approve the terms and conditions of the <br />survey contract, as required under Section 14{A). <br />The proposed method of permanently sealing exploration holes, <br />borenoles and wells outlined in Section 2.05, page 2.05-77 pursuant to <br />Rule 4.07.3 1s not 1n compliance with 43 CFR 3484.1(3). Our agency <br />regulations require under Federal leases and licenses that holes <br />drilled deeper than stripping limits shall be plugged through the <br />thickness of the coal Deds and through aquifers for a distance of at <br />least 50 feet above and below the coal beds and aquifers. State of <br />Colorado Rule 4.07.3 doesn't require any plugging through the <br />thickness of the coal beds. In addition, Rule 4.07.3 only requires <br />plugging tnrougn aquifers fora distance of at least 20 feet above and <br />below the aquifer. Therefore, the suD,)ect Dermit revision is not in <br />compliance with our agencies regulations as they pertain to <br />exploration hole plugging. <br />Identification of Lands Unsuitable for Surface Minin and Reclamation <br />ursuant to ection o <br />Through our land use planning process, none of the lands contained in <br />Federal coal leases C-16284, C-081330, D-52547, and C-0128433 within <br />this permit revision boundary have had the unsuitability criteria <br />applied. <br />Pursuant to 43 CFR 3461.4-2, we do not apply unsuitability to leased <br />lands. However. the following lands within the revised permit <br />boundary havr had.uaieltability applied. <br />T.5N., R.86W., 6th P.M. <br />ec.
