,. <br />Sherman & Howard <br />Mr. Fred Banta <br />March 8, 1983 <br />Page Two <br />Counterpart performance bond documents in the form of the <br />attached specimen will be executed immediately following the Closing <br />of the transaction between Buyers and Utah, and then will promptly <br />be submitted to MLR. <br />The resident agent of Trapper, a Colorado corporation, that <br />will accept service of process after Buyers acquire the common stock <br />of Trapper is Gary M. Stubblefield, whose title is General Superinten- <br />dent of the Trapper Mine, and whose address is c/o Trapper Mining Inc., <br />Post Office Box 187, Craig, Colorado 81626. <br />With respect to officers of Trapper, you should be advised <br />that as of the Closing of the purchase and sale of the common stock <br />of Trapper, the present officers will resign. No new officers will be <br />appointed until the new Board of Directors of Trapper is properly con- <br />stituted and has an opportunity then to so act. There are presently <br />no officers proposed for appointment. Buyers and Trapper will promptly <br />notify MLR as soon as new officers of Trapper are properly appointed <br />after the Closing. <br />Concurrently with the submission of this additional informa- <br />tion to MLR, Buyers are re-publishing notice of the application for <br />change in indirect ownership of permit rights in The Daily Press, <br />Craig, Moffat County, Colorado. Proof of this re-publication will be <br />filed with MLR as soon as it is received from The Daily Press. <br />Buyers believe that the information contained in this <br />letter, together with that contained in my letter of February 9, 1983, <br />constitute all of the information required to be submitted in connec- <br />tion with this application by the MLR regulations. As of today, all <br />such information has also been filed with the Office of Surface <br />Mining. Please let me know if you require additional information or if <br />you have any questions.
