Overburden and topsoil stockpiles shall be kept at a minimum by replacing onto mined out <br />previous units. Stockpiles for final reclamation shall be re-vegetated until final use. <br />10.) A minimum of 2 feet of overburden or crusher reject (fines) shall be placed on any shale <br />exposed by mining activity within 180 days to minimize and prevent selenium exposure. <br />The underlying Mancos Shale appears to be previously oxidized and weathered (See Soils <br />Report. <br />EXHIBIT E -Reclamation Plan <br />11.) Statement providing a three year guarantee on the re-vegetation has been removed and <br />replaced with "re-vegetation shall be firmly established as determined by inspection by <br />Division of Minerals and Geology personnel". <br />12.) Statement that "No topsoil will be saved so underlying soils will be conditioned" was <br />removed and replaced with "specific unit by unit handling of the overburden and topsoil". <br />Exhibit L cost estimate was revised to reflect handling of topsoil and overburden. Across <br />section will be added to show final reclamation surface. <br />13.) The existing high waterline of the pit before discharge is elevation 4816.15. A ten (10) year <br />24 hour storm event shall be entirely contained within Unit 1 and Unit 2 detention area and <br />will accumulate storm water ( cu. ft.) from elevation 4813 to elevation 4816. <br />14.) Unit designation has been revised for soils handling and reclamation activities on Exhibit E. <br />The seed mix has been changed to follow the approved BLM criteria and application rates <br />for arid re-vegetation (see enclosed.) <br />15.) Re-vegetation seeding shall be scheduled in the fall between Sept. 1 and Oct. 15. <br />EXHIBIT F -Reclamation Plan Map <br />16.) Reclamation Plan Map as been revised to reflect final reclamation appearance. <br />EXHIBIT G -Water Information <br />17.j Response to Rule 6.4.7 (3) <br />The existing operation consumes approximately 120,000 gallons of water annually for the <br />development, mining and crushing and screening of the construction materials. No water <br />usage is proposed for reclamation. <br />Response to Rule 6.4.7 (4) <br />The only source presently used or proposed is supplied 100% by Ute Water. <br />Response to Rule 6.4.7 (5) <br />Upland Gravel is not required to apply fora (NPDES) permit because no discharge of <br />storm water is proposed or has occurred from the site. If necessary, the applicant shall <br />apply fora (NPDES) permit. <br />
