(W WL), agent for Gknn Springs Holdings, Inc. (GSIin and Occidental <br />Oil Shale, lnc. (OOSI), has prepared this letter in response to the Division of Minerals and Geology <br />(DMG) letter of April 15, 2004 which contains a review of W WL's response (April 9's, 2004) to <br />DMG's response to Technical Revision No. 4 (TR No. 4) wnceming the Research Mine portal seal. <br />ht previous correspondence, W WL and DMG have discussed and proposed monitoring stipulations for <br />the Research Mine portal seal. This letter will summarize the key monitoring stipulations including <br />new stipulations in response to your letter of April 15'". <br />Monitoring ofthe Research Mine portal seal includes the following: <br />1. The monitoring period will be from April to December. <br />2. Monitoring will be conducted on a weekly basis during the monitoring period. <br />3. Monitoring will be suspended each year after the head behind the seal has peaked and subsided <br />to zero, under the condition that monitoring is to resume in any given yeaz should conditions <br />occur that could reasonably result in a significant increase of mine pool head behind the <br />Research Mine portal seal. <br />4. DMG is to be notified within 24 hours if seepage is observed from the portrtl seal area or if <br />head in the mine, as indicated by the manometer gauge outside of the portal, reaches a value of <br />3.5 feet (1.5 pounds per square inch gauge pressure). <br />5. Should the observed head in the mine pool indicate a 3.5 ft depth, water will be released from <br />the mine pool by way of the valve on the existing Crinch diameter discharge pipe inshelled <br />through the portal seal. <br />6. Sampling of any discharged water will be in accordance with the Colorado Department of <br />Public Health and Environment (CDPHE) National Pollution Discharge Elimination System <br />(NPDES) alsd known as the Colorado Discharge Pemut System <br />A1~AGrutrons m Earth Socncc 743 Horizon Court Stite 330.
