-2- <br /> <br />On July 19, 1985 the Division approved a mining and reclamation plan for <br />the Revision 2 Area (Deep Creek Canyon). This area, a 98.64 acre tract, <br />is located south of the mine facilities area across Highway 151 in Deep <br />Creek Canyon. The permittee did not receive Federal approval for this <br />revision area, therefore, Chimney Rock withdrew the revision on January <br />14, 1986. <br />The actual disturbed area at the mine site totals 187.5 acres; 86.7 acres <br />in the original and Barren Ridge areas; 22.9 acres in the Revision 1 <br />area. Seventy point seven percent or 61.3 acres remain to be reclaimed <br />in the original and Barren Ridge area, while 98.26 percent or 22.5 acres <br />remain unreclaimed in the Revision 1 Area. <br />On September 30, 1985, the Division was form <br />temporary cessation of mining at the Chimney <br />this notification, the total permitted area, <br />Area (Deep Creek) was 187.5 acres. Decision to Require Revision <br />Based on this mid-term review the Division finds that certain revisions <br />and modifications are needed to ensure future compliance with the <br />Colorado Surface Coal Mining Reclamation Act and the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining. The following <br />section details the revisions required, justification for requiring the <br />revisions, and timetable for submitting the revisions. All responses <br />should be submitted as one package by April 1, 1986, while bonding <br />responses should be submitted by March 15, 1986. <br />The Division has noted during this review that six (6) stipulations <br />appear to have not been addressed. These stipulations must be satisfied <br />within the time frames noted above. <br />
