<br /> <br />Mid-Term Review <br />Chimney Rock Coal Company <br />Chimney Rock Mine <br />C-023-81 <br />Introduction <br />This document presents the results of the Division's mid-term review of <br />Chimney Rock Coal Company's Chimney Rock Mine. This mid-term review was <br />conducted to fulfill the requirements of Rules 2.08.3, 2.06.2(9), 2.06.3(4), <br />2.06.5(3), 2.06.7(5) and 3.02.2(4). <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued, <br />prior to its mid-term (2-1 /2 years). Based on this review, for good cause <br />shown, the Division may require reasonable revision or modification of the <br />permit provisions to ensure compliance with the Act and Regulations. <br />This mid-term review consisted of a detailed review of the Chimney Rock Mine <br />permit application to identify any items that may have been overlooked during <br />the initial review. The Division also reviewed all subsequent revisions and <br />stipulation responses to ensure that all permit commitments and conditions <br />were being followed and to ensure that the mine is being operated in <br />compliance with the Act and Regulations. Hydrologic monitoring data were <br />reviewed in conjunction with the review of the application to assess the <br />adequacy of the monitoring plan and discussion of hydrologic impacts. <br />Problems and observations from past inspection reports were also considered. <br />A detailed analysis of the adequacy of the reclamation bond was also conducted. <br />I. History <br />On January 7, 1983, Chimney Rock Coal was granted a five (5) year <br />permanent regulatory program permit (No. C-023-81 ). <br />The original permit area is a 100 acre tract known as the 'East Pit <br />Area'. Also permitted with the original area was the 40 acre Barren <br />Ridge tract; north and west of the facilities area, across Stollsteimer <br />Creek. <br />On January 16, 1984, Chimney Rock received a permit to mine the Federal <br />coal lease area north of Barren Ridge. This 47.5 acre tract is referred <br />to as the 'Revision 1 Area'. <br />
