LOng <br />Division Director <br />Listed below aze adequacy review comments for the Kues Gravel Pit 1 lOc to 112c Permit Conversion Application, File No. <br />M-1983-187. The Division of Minerals and Geology ("Division") is required to make an approval or denial decision no <br />later than January 23, 2002, therefore, your response to the following adequacy review concerns should be submitted to the <br />Division as soon as possible. <br />1. On December4, 2001 the Division received the proof of public notice of the Kues Gravel Pit posted in the Sterling <br />Journal-Adoca[e. The proof of publication states that the public notice was published on October 24,31, <br />November 7, ] 4 and ] 9, 2001. The notice states [hat comments must be in writing and must by in writing and must <br />be received by the Division by 4:00 P.M. on November 15, 2001. Based on the date of the last publication date <br />(November 19) and the date that comments must be received by the Division as stated in the notice (November 14, <br />2001), no comment period was allocated. Rule 1.7.1(2)(a) of the Conswction Material Rules and Regulations <br />requires a 20-day public comment period from the last date of newspaper publication. Logan County will need <br />Io re-publish the public notice only once, and allocate a 20-day public comment period. Once i[ is obtained, please <br />submit proof of publication of the new public notice. <br />2. Rule 6.2,1(2) required that maps be signed by a registered land surveyor, professional engineer, or other qualiFed <br />person. The maps submitted to the Division were not signed. 1n addition, the maps do not contain a north arrow <br />or a map scale. Please resubmit a signed copy of the maps and include a north arrow and map scale. <br />3. The Division received correspondence from the Office of the State Engineer and the Department of the Army <br />regazding the application. Attached are copies of the letters for your files. <br />Rule 6.4.3 Exhibit C-Pre-Mining and Minin>? Plan McD(S) of Affected Lands <br />4. Rule 6.4.3(a) requires the applicant to show all adjoining surface owners of record on a map. Please submit a map <br />depicting the adjoining surface owners. <br />Please include a map that depicts the existing topography of the area with contour lines in sufficient detail to <br />porvay the direction and rate of slope of the affected ]and. <br />Rule 6.4.4 Exhibit D-Mine Plan <br />6. The applicant states that 4 inches of topsoil is present and will be snipped and stockpiled from the active mining <br />area. Please locate the proposed topsoil stockpile on a map. In addition, if present, overburden piles need to be <br />depicted on a map. <br />Rule 6.4.4(f) (ii) requires the applicant to describe the nature of the svatum immediately beneath the material to be <br />mined. Please describe the nature of the svatum located below the deposits to be mined. <br />
