The parties who did not at[end the Pre-hearing <br />Conference will not be allowed to present exhibits or introduce witnesses at the Board hearing <br />unless approved by the Board Said parties will not be given an opportunity to conduct cross- <br />examination ojany witnesses that testifed during the presentation unless approved by the Board. <br />Applicant Exhibits: <br />All listed exhibits, except photographs, were exchanged by the parties present at the <br />Prehearing Conference. <br />Members of the public wishing to testify at the Forma! Public Hearing may submit written <br />and /or oral testimony [o the Board during the designated time period for public comment at the <br />hearing. Although only one copy of written testimony is required for non parry witnesses, it is <br />recommended that 11 copies be provided to allow for full consideration by the Board and staff. <br />All documents, exhibits and photographs presen[ed as evidence at the Formal Public <br />Hearing will become part of the administrative record. Upon request, a party may recover any <br />evidence introduced by that parry, if no action for judicial review is commenced within thirty (30) <br />days of the date agency action in [his matter becomes effective. <br />VI. PROCEDURE <br />The Division, parties and members of the public shall make presentations in the following <br />order. The time limits set out below are maximum limits and shall be strictly enforced The Board, <br />in its discretion, may nllow additional time when warranted. The Board has the right to limit any <br />redundant or irrelevant testimony. At the conclusion of each presentation, and within time limits <br />set by the Board, there will be an opportunity to conduct cross-examination of any witnesses that <br />testified during the presentation. <br />The Pre-hearing Conference Officer shall present the Order to the Board for adoption. <br />1. The Board will hear arty objections to the Pre-hearing Order. <br />3. Board's Consideration and Adoption of the Pre-hearir:g Order. <br />d.
