Shuey <br />Colorado Division of Minerals and Geology <br />January 13, 1999 <br />Page2of3 <br />(3) Partial Release of Financial Warranty: CBCI intends to facilitate performance of the <br />phased reclamation plan through timely request(s) for partial financial warranty release <br />following execution of specific phases andlor components. <br />Accordingly, request(s) for partial financial warranty release will be carried out in <br />conformance with Rule 4.16 of the Hard Rock and Metal Mining Rules and Regulations. <br />(4) County Road 361 Bridge: The existing bridge which crosses Sneffels Creek at the <br />Camp Bird Mine entrance is owned and maintained by Ouray County. CBCI is currently <br />evaluating improvement alternatives independently and in conjunction with Ouray County. <br />CBCI anticipates that only a limited number of crossings by heavy equipment will be <br />required, principally as associated with Phase II of the reclamation program (e.g., during <br />the summer 2000 field season). Regardless, repetitive hauling across the bridge is not <br />proposed for either phase of the reclamation program. Over the next 18-months, CBCI <br />anticipates that required bridge improvements can be accomplished. If not, and in lieu of <br />bridge usage, it is anticipated that shallow streambed crossing can be utilized for the <br />limited heavy equipment requirements. Such a streambed crossing can be accomplished <br />with minimal earthwork (ramping) at a suitable location, utilizing equipment already <br />mobilized to the site. <br />Based on the above circumstances, CBCI requests that any related increase in the <br />financial warranty amount be eliminated from further consideration. <br />(5) Completion of Reclamation Program: CBCI envisions that the phased reclamation <br />program will be substantially complete upon conclusion of two field seasons (e.g., by the <br />end of the year 2000 field season). <br />CBCI will provide a conforming commitment to execution of the phased reclamation <br />program within the Phase I Technical Revision to be submitted not later than January 25, <br />1999. <br />
