Consistent with subsequent discussions <br />between MLRD and our technical consultant J. M. Beck R Associates, Camp Bird Colorado, Inc. <br />(CBCI) herein provides the following responses pertaining to the imposed conditions as described <br />on page two of that letter. <br />(1) Technical Revision Application Submittal: CBCI requests modification of the stated <br />submittal date for a Technical Revision Application to Monday, January 25, 1999 (thirty <br />days prior to the next scheduled Mined Land Reclamation Board meeting). CBCI intends <br />to submit, not later than that date, a Phase I Technical Revision pertaining to the first <br />phase of a two-year phased reclamation program. Specifically, the Phase I Technical <br />Revision will address reclamation activity to be pertormed during the 1999 field season for <br />that portion of the Permit Area north of Canyon Creek. <br />Accordingly, CBCI herein requests scheduling for an appearance before the Mined Land <br />Reclamation Board's February 24-25, 1999 meeting to formally propose and seek <br />acceptance of the phased reclamation program. <br />(2) Financial Warranty Status: CBCI recognizes that MLRD has recalculated the financial <br />warranty amount such that it exceeds the existing financial warranty. Activities are <br />currently underway (e.g., installation of a secured portal closure), or scheduled to be <br />completed (e.g., portal area structure demolition) in advance of summer 1999 reclamation <br />earthwork activities. On completion of these activities, CBCI is confident that the <br />exceedance amount of $18,544.00 can be eliminated prior to or in conjunction with <br />startup of 1999 field season reclamation activities. Assuming Board approval of the <br />Phase I Technical Revision by February 25, 1999, CBCI would be required (per Rule <br />4.2.1(7) of the Hard Rock and Metal Mining Rules and Regulations) to submit adequate <br />financial warranty within 60 days, or by approximately April 25, 1999. It is reasonable to <br />expect that site conditions (snowpack) at the Camp Bird Mine would preclude completion <br />of {and submittal of adequate documentation thereof) these activities by that specific date. <br />Based on that expectation, CBCI herein notifies the MLRD of its intent to petition fora 90- <br />day extension of the financial warranty due date to July 25, 1999. Said petition for <br />extension will be introduced during the scheduled appearance at the February 24-25, <br />1999 MLRB meeting. <br />
