As an example, it is not clear whether mining activities <br />will occur in areas outside of phases 2, 3, and 4 but within the <br />"limits of mining" line shown on the Mine Flan map. <br />After reviewing information shown on maps prepared for the County <br />Master Plen for this operation, it. appears that at least one <br />irrigation ditch exists within 200 ft. of the permit area boundary <br />but is not shown on the Mine Plan Map. Also, a review of the <br />Wildlife Mitigation Plan Map indicates that a creek or other type <br />of drainage channel may be situated within the permit area <br />immediately west of the phase 5 area but is not shown on the Mine <br />Plan Map. For these types of features and regarding permanent man- <br />made features in general, the Mine Plan Map may need to be updated <br />to clearly show ell creeks, presently existing buildings, oil t~ gas <br />wells and lines, power end communication lines, end other permanent <br />man-made structures located within 200 ft. of the permit. area. <br />It does not appear that either the Mine Plan Map or the Reclamation <br />Plan Map show contour lines of sufficient detail to portray the <br />direction end rate of slope of the affected land. Also, it does <br />not appear that specific drainage control structures that. may be <br />associated with the Stormwater Management Plan have been included <br />on an appropriate map. Please provide this necessary information. <br />It does not appear that adjoining surface owners of record have <br />been shown on an appropriate map contained in the application <br />materiels. Please clarify. <br />GAS WELL & OTHER PERMANENT MAN-MADE STRUCTURES <br />Due to the proximity of the gas well to the phase 7 extraction <br />area, the operator will either need to: 1) Demonstrate that the <br />mining operation will not adversely affect the stability of this <br />structure; or 2) Provide the Division with sufficient evidence of <br />an agreement between the operator and the persons having an <br />interest in the structure that damage to the structure is to be <br />compensated for by the operator. An agreement covering relocation <br />of the gas pipeline may be in existence, however our files do not <br />appear to contain any documentation regarding the above ground <br />portion of the facility. This requirement also pertains to any <br />other permanent men-made structures such as barns, houses, storage <br />sheds, etc. existing on or within 200 ft. of the effected area. <br />MINE PLAN DETAILS <br />A section of the mine plan states that "most of the mining in the <br />existing pit will occur primarily during the months of March <br />through September with some year round work". This section of the <br />application should be clarified to indicate whether this statement <br />refers to the phase 5, 6, & 7 area es well end in addition should <br />be worded to be consistent with any working schedule restrictions <br />2 <br />
