Haweuer, as discussed in <br />Section V.A.2.a ojrhe Rationale, some jacilitier may x•irh to apply for an individual permit instead, in order to take <br />advantage ojsome federal egIuent guidelines not included here. Additionally, as discussed in Section 11/.B of the <br />Rationale, the Water Quality Control Division ojrhe Colorado Department ajHeahh (the 'Division') retains the authority <br />to require any facility to be cns+cred under an individual permit. <br />11I. COYERACE UNDER THIS PERMIT <br />A. New Industrial Caterories <br />The type ojjadliries covered by this permit has been broadened to include all mining and quarrying of nonmetallic <br />minerals, except juelr. This is the description ojS~andard IndusMal Classification (S1CJ Codt I4. 1he permit <br />presdausly covered only construction sand and grass! mining (SIC Code 1442), bur has been changed ro include <br />these new categories due to tlu addition ojstormx~atcr prosisions for these same cruegorier (see Section V.B of the <br />Rationale). Also, stormwater from asphah and connere batch plants located ru sand and gravel operations is <br />included here, due ro their similarity to the mvrred miner in pollution paremial, and their function as an adjunct to <br />the mine operwions. General vs. Individual Permit Corrmee <br />Any owner or operator authorized by rhir permit may request ro be erclrtded from the cnxerage of this permit by <br />applying for an individual CDPS permit. The ox•ner ar operator shall submit an individual application to the <br />Division, with reasons supporting the request. <br />Alternately, if, after evaluation ojrhe application (or additional information, such as the SWMPJ, it i.s found that <br />this general permit is not applicable ro the operation, then the application may be processed as one for an <br />individuol permit, or a more appropriate general permit. The applicant will be nor~ed of (he Division's decision to <br />deny certification under this general permit. <br />C.
