Where semi-annual site uupections are shower in the plan to be unpractical for inactive sites (sites where <br />industrial activity is no longer conducted), site inspections required by this part shall be conducted et <br />appropriate intervals specified in the plan, but, in no case lac. than once in three years. At le:~x one site <br />inspection required under this part shall be conducted prior to October 1, 1994 or the date two years after such <br />site becomes inactive, whichever is earlier. <br />4. Additional S1V11CP ReauirertenLs <br />a. Signatory Requirenenfs: A copy of the plan shall be signal in accordance with Part I.D.lO.e, and retained <br />on site. A certification that the plan has been completed and implemented shall be signed and submitted to the <br />Division in accordance with SWMP Deadlines, Part i.C.ti.e, below. <br />b. SWA1P Review/Changes: Upon review of the SWMP, the Division may notify the permittee et any time that <br />the plan does not meet one or more of the minimum requirements of this permit. After such notification, [he <br />perntittee shall make changes to the plan and shall submit to the Division an update to the plan including the <br />requested changes. Unless otherwise provided by the Division, the pertnittee shall have 30 days after such <br />notification to both make the necessary changes to the plan and to implement them. <br />The permittee shall emend the plan whenever there is a change in design, construction, operetion, or <br />maintenance which has a significant effect on the potential for the dixharge of pollutants to the waters of the <br />Stale, or if [he SWMP proves to be ineffeclivein achieving the general objectives of controlling pollutants in <br />storntweter discharges associated with industrial activity. Amendments to the plan may be reviewed by the <br />Division in the same manner as described abode. <br />It is Ute permittee's responsibility to notify theColorado Division of Mining and Geology (formerly the Mined Land <br />Reclamation Division) of any significant changes at ))lair site resulting from the implementation of the SWMP. <br />5. SWI1iP Availability <br />A copy n( the SWMP shall be provided to the Division, the Colorado Division of Mining and Geology (CDMG), and/or to <br />EPA upon request, and within the time frame specified in the request. <br />All SWMPs required under this permit are considered) reports that shall be available to the public tinder Section <br />308(b) of the CWA. The owner or operetor of a facility with stormµaler dixharges covered by Wis permit shall <br />make plans available to members of the public upon r~uest. However, the permittee may claim any portion of a <br />stormwater pollution plan as confidemtial in accordance will[ 40 CFR Part 2. <br />6. S1YI11P Dcadlinlx. Cerlificnti m I <br />e. Certification oC SW11CP Completion and Lmpltirtentation: For facilities existing on October I, 1992, as <br />soon as possible but no later than the anniversary date of their Mined Land Reclamation permit that falls <br />between July 1, 1993 and June 30, 1994, the permittee shall have implemented and be in compliance with <br />their SWMP. <br />I <br />i <br />Certification of compliance with the SWA1P shall be submitted to the Division on or before the anniversary <br />date of the Minctil Land Reclamation permit that falls between July 1, 1993 and June 30, 1994. <br />For any existing facilities covered under this permit which do not also Rave a reclamation peRnit under <br />CDMG, the SWh1P certification of completion and implementation is due to the Division by July I, 1993. <br />For new Cac~lilies (beginning operations after October 1, 19921, and (or all other facilities applying after <br />July 1, 1993, the SWMP shall be prepared prior to applying for coverage under the general prrtnit, and <br />certification of the plan development suhmitted with the application.
