P. o. o x 5 5 3 <br />Subject: M-77-393; Jenkins Site - Technical Revision to satisfy conditions <br />specified in the OMLR's inspection report of 21 February 1995. <br />In response to our meeting Monday 20 March 1995, it was agreed that the following <br />minor changes to the permit would provide significant improvements to the affected <br />lands while enhancing Varra Companies ability to correct the problems identified in <br />the 2/21/95 inspection report. All work identified under this Techni~.al Revision <br />will be completed on or before 1 May 1995, unless an extension is needed for good <br />cause shown (e.g., delays due to weather, delays in materials, delays due to <br />inspections or other required approvals), provided Varra Companies coimnunicates <br />such causes to the OMLR in a timely manner. Regardless, completion of activities <br />approved under this Technical Revision will satisfy compliance with the terms of <br />the permit and conditions otherwise required in the OMLR inspection r~=_port of <br />2/21/95, specified as Option N1 on page 3 of that report. <br />1. Lands presently permitted or affected North of Coal Creek will remain open to <br />excavation and no reclamation activity is required prior to 1 May 199.1. The OMLR <br />inspection report of 2/21/95, acknowledges adequate soil salvage for :his portion <br />of the site. <br />NOTE: The balance of the Technical Revision pertains to lands located South of <br />Coal Creek within the permit boundary, referred to herein as the Soutli Site. <br />2. Stockpiles dispersed over affected lands on the South Site are as:;ets which <br />will be protected and preserved for later removal relative to and conditional upon <br />market conditions: <br />*' Commercially viable stockpiles will be clustered in place and graded to a <br />3h:ly slope or flatter. Smaller or uncommercial stockpiles will be eliminated. <br /># Upon completion of grading of the stockpiles, OMLR will inspect and approve the <br />final size and locations of stockpiles designated by Varra Companies t:o be a viable <br />asset. Any modifications would be determined at the time of that ins~~ection, and <br />adequate time will be provided to satisfy any necessary changes agreed to. <br /># Upon finalizing stockpile grading, stockpile locations will be idf~ntified on a <br />map. Stockpile locations and size will be considered approved at the time of the <br />OMLR inspection as part of this Technical Revision. The map will also be considered <br />as part of this Technical Revision. <br />- 1 - <br />
