The <br />provisions of CMLRB Rule 1.56(5) are therefore not applicable <br />to this operation. <br />Comment• <br />Exhibit C - Mining Plan Map <br />1) The mining plan map(s) and permit boundaries should be <br />amended to show all access roads. <br />2) Mining plan maps must show all processing locations, <br />topsoil storage areas, product stockpile locations and <br />any other aspects of the operating mine. <br />Response: <br />Please refer to the revised Mining Plan Map - Layout of <br />Facilities (Exhibit C) . <br />Comment: <br />Exhibit D - Mining Plan <br />1) Topsoil s:~lvage and protection is required by State Law, <br />specifica:Lly CRS 34-32-116(1)(q). The sale of all <br />topsoil i:> technically a violation of State Law and must <br />not occur in future operations unless the operator can <br />prove that: excess topsoil is available after reclamation <br />needs are met. Overburden materials are usually not as <br />suitable S:or revegetation purposes as are topsoil <br />materials. Please specify the depth to which all topsoil <br />encounte[E~d in the future will be stripped for salvage. <br />The SCS report indicates 12 inches of available topsoil <br />material and similar salvage depths seem viable, <br />especiall~~ given previous topsoil sale. <br />2) Specify tb.e amount of topsoil in cubic yards to be <br />salvaged and the actual number of acres which will <br />require topsoil redistribution. Given the future lake <br />surface reclamation, there should be sufficient topsoil <br />from future operations to reclaim all areas of the mine. <br />3) Specify topsoil storage locations. <br />
