BRL rechecked property records and provided revised Map <br />9-2 of Volume 9 and pages 7 through 11 of Section 2.03 of Volume I in the submittal dated June <br />15, 2004. <br />4. The name of Stephen HGrosse-Rhode appears twice in the list of surface owners zznder Rule <br />2.03.4(7). Please revise. <br />The Division has no further concerns. In the submittal dated June I5, 2004, BRL provided revised <br />pages 7 through 1 1 of Section 2,03 in Volume 1. <br />5. Rule 2.10.3(1)(a) requires that a map be provided that shows the names and boundaries of <br />subsurface owners within and contiguous to the permit boundary. However, approved Map 9-S <br />does not show the names associated with the private coal ownership areas. Please revise Map 9-.i <br />accordingly. <br />In the submittal dated June 15, 2004, BRL provided revised Map 9-5 of Volume 9 and revised <br />pages 6, 1 1, 12 and 13 of Section 2.03 of Volume 1. However, the Division has three additional <br />questions: <br />a. The owners of record of the coal to be mined, as listed on page 6 of Section 2.03 of the <br />submittal dated June 15, 2004, do not appear on revised Map 9-5. Please update this map <br />accordingly. <br />b. There are three subsurface owner entries that appear on pages 1 1 and 12 of Section 2.03 [hat <br />do not appear on Map 9-5. The entries are Oscar E. Osteen and Freda M. Osteen, Robert <br />Hoelscher and Randall W. Leacock. Please rectify this discrepancy. <br />c. The name of [he Peter G. Watson Living Trust appears as a subsurface owner on the <br />subsurface owner list on Map 9-5 and on page 13 of Section 2.03. However, the <br />subsurface area is not denoted on Map 9-5. Please revise accordingly. <br />6. Concerning the list ofsubsurface owners contiguous to the permit area in section 2.03.4(7), there <br />are two listings in the approved permit application that do not appear in the SO-4 submittal. The <br />listings are Ester L. and Connie G. Johnson and Haxel A. Barnes. Please revise or explain. <br />The Division has no further concerns. Page 2.03-4 of Volume 7 was revised in the submittal dated <br />June 15, 2004. <br />On Map 1, Surface and Subsurface Ownership, approved in RN-04, there appear to be properties <br />that are or may be contiguous to the unit train loadout permit boundary that are not listed under <br />Rule 2.03.4(7) in the SO-4 submittal. The property of Daniel Johnson (custodian for Eugene <br />Kodiak Johnson), identified as property number 45 on Map 1, appears to be contiguous to the <br />unit train loadout permtt boundary. Ifso, please add the name to the surface owner list under <br />Rule 2.03.4(7) in the SO-4 submittal. Also, it appears that a portion of the west side ofproperty <br />owned by Melvin A., Michael A. and Marvin A. Bencich, identified as property number 39 on Map <br />1, appears to abut the permit boundary of the railroad spur line. If true, please revise the list of <br />contiguous surface owners in the SO-4 submittal. <br />
