The Colorado Division of Minerals and Geology (Division) has finished its review of Bowie Resources
Limited's (BRL) responses, in submittals dated June 15, 2004 and June 25, 2004, to the Division's
adequacy review letter dated January 27, 2004. The Division has the following comments and questions:
Rule 2.03.4
As a part of the permit renewal process, the Division needs to contact all surface and mineral
owners of the affected land within the permit area, as required under Rule 2.08.5(3)(b). As a
matter of convention, the Division contacts all surface and subsurface owners within the permit
area. The names and addresses for all of these owners are taken from the operator's responses to
Rule 2.03.4(6)(a). Therefore, please include in your response to Rule 2.03.4(6)(a), a[l ofthe
surface owners within the permit area, regardless of whether or not the [and has been affected by
surface operations.
The Division has no further concerns. BRL listed all of the surface owners, within and contiguous
to the permit area, in Section 2.03.4(7) rather than in Section 2.03.4(6)(a). Pages 7 through 11 in
Section 2.03.4(7) of Volume 1 and pages 2.03-2 through 2.03-6 of Volume 7 were revised in the
submittal dated June 15, 2004. The same list of names appears on revised Map 9-2 of Volume 9
and Map 1 of Volume 7, also presented in the submittal dated June 15, 2004.
2. The names of Mary Beth Grosse-Rhode Wheller and Janice Grosse-Rhode Archuleta appear on
Map 9-2, approved in RN-04, but do not appear in the list of surface owner names in the Rule
2.03.4(7) section of the SO-4 submittal. Please clarify.
The Division has no further concerns. BRL rechecked property records and revised the list of
surface owners on pages 7 through I I of Section 2.03 of Volume l and Map 9-2 of Volume 9 in
the submittal dated June 15, 2004.
3. Several of the names listed in the Rule 2.03.4(7) section of SO-4 do not appear on Map 9-2 that
was approved in RN-04. These names are North Fork Coal, G-R Land and Cattle Company,
Clarence E. Yanaken and Nancy L. Vanaken, Billy G. McKinney and Patricia J McKinney and
Douglas R. Winter. Please revise either the SO-4 text or Map 9-2 accordingly.
