980.006) Pond FPermanent Status Request (continued) <br />Pond F would therefore meet the state's rule 4.05.9 (13xd) that, "water impoundments shall <br />trot result in the dimimttion of the quality or quantity of water available to water right holders <br />for agricultural, industrial, recreational or domestic users except in accordance with <br />applicable state law ". Further, Kerr holds an existing absolute water right for the pond decreed <br />in 1986 that did not require an augmentation plan or bypass flows at that time. <br />Kerr has discussed this matter with the BLM on several occasions and they have stated they <br />concur with this request to keep Pond F on a permanent basis.
