Box 3450 <br />Steamboat Springs, CO 80477 <br />Re: Marr Mine (C-1980-006) Pond F Permanent Status Request <br />Dear Ms Light: <br />AUG 3 0 X006 <br />WATEq RE90UgCE9 <br />•TATE ENOINEiq <br />coo. <br />Ken Coal Company (Kerr) has requested the Colorado Division of Minerals and Geology <br />(CDMG) to change the status of Pond "F" at the Man Mine to permanent. The pond is located in <br />the NEl/4 SWl/4 NEl/4 of Section 26, Township 9 North, Range 78 West in Jackson County. <br />The pond currently serves as a sediment pond that collects runoff from about 63 acres. In <br />addition, a small ditch (PD-3) diverts runoff from a mined area to the pond, which makes the <br />total contributing drainage area approximately 123 acres. The pond is located on BLM public <br />lands and is part of a livestock grazing allotment. The pond provides livestock water during the <br />spring and is generally dry by mid-July, based on pre-2000 records. <br />Ken has obtained copies of letters to the CDMG from the Office of the State Water Engineer <br />raising concerns about Pond F being out-0f priority in most years, i.e., after spring runoff <br />through late fall. Given that the BLM is the landowner, Ken has forwarded copies of the Water <br />Engineer's letters to the BLM as well. In a Division of Water Resources' memorandum dated <br />May 16, 2006, Mr. Lis assumes that the pond is intended to be full year round and needs a plan <br />of augmentation or the ability to by-pass inflows. Due to these concerns, the Division has <br />recommended that Ken Coal Company contact the State Engineer's Office which has caused the <br />permanence decision (by the Division) of the pond's status to be postponed. <br />Ken would like to request that the State Engineer's Office reconsider their comments and allow <br />the request for permanent status ofPond F to proceed. Ken's consultant, Northwest Colorado's <br />Consultants, Inc. (NWCC) Pond F Permanent Pond Request Demonstration' described Pond F <br />as located on a small ephemeral drainage with a dam height of 10 feet. The storage capacity is <br />4.8 acre-ft active and 1.8 acre-ft dead. The pond's riser pipe generally discharges for 2 - 3 <br />weeks in the spring, with no discharge in 2000 - 2004. The pond appears to fit the requirements <br />of a livestock water tank which is an exempt dam and would continue to be used as such once <br />Ken completes all state reclamation requirements. Representatives of the BLM have stated (as <br />well as Ken) that they are willing to complete an application form pertaining to a livestock <br />water tank if so required. <br /> <br />
