attributed to the Prelaw lands, but was not included in the warranty sir
Prelaw, but was included in the 25 acres since its status had
completed by field verification under the more accurate aerial map,
still pending at the time. Once the Prelaw lands have been verified, tl
Subsequent to their release, the Prelaw lands are being reclaimed
As provided for in the Conversion permit under Exhibit F:
Where reclamation and revegetation is attempted on pre•
affected lands [PL] and pre-law marginally affected lands [MLJ,
requirements of Rule 3.1.10(1) will be waived, per F
3.1.10(8)(e). Where revegetation is successful on pre•
affected lands and pre-law marginally affected lands it s
provide credit to the operation under Rule 3.1.10(9) as substi
lands for those areas where revegetation efforts fail on affe
lands [AL] to an equivalent extent as, where such lands t
received a minimum of two seeding/planting attempts over a
year period [typical phase upon completion of mining) during
life of the operation.
it was
been
it was

~^wi o
M1"'
~0
The Prelaw lands once reclaimed can function as substitute I ds, and
therefore as a credit toward the financial warranty applied against th 25 acre
total, or against failed areas. The credit would be available as the Pr law lands
are reclaimed and the reclamation is verified by the Division.
Since only 25 acres can be Affected under the Conversion, and si ce 12.84
acres are already Affected, this would open the remaining 12.16 acres to
expand operations. However, since the Operator is also the Iando ner, and
since the majority of the Roads over the property are pre-existing an suitable
to advance the Post Quarry Land-Use, and considering the Capitol orth of a
road on steep terrain, a majority of the roads should be retained [esti ate 90%
of those exiting or advanced over the face of the hillside]. This cont ibutes an
additional 2.07 of the 2.30 acres of Roads for further expansion, and hould not
be accounted for in the financial warranty determination for the Affect~d Lands. _ 0
I
Now the total of available lands for quarry expansion is 12.16 + 2.07 = 14.23
acres. Since the storage areas are on Prelaw land and of no consequence to
their pre-existing condition, the total of available lands for uar ex ansion is
now 14.23 + 1.12 = 15.35 acres.
In establishing the financial warranty to provide for 25 acres of Q~
each acre should be estimated for the maximum amount
disturbance. In this manner, the accounting can focus on the nun
of Affected Land, with the knowledge that each acre is slightly
since such a scenario with concurrent reclamation necessary for
ed Land,
possible
of acres
bonded
re quarry
4

Rocky Road Investment, Inc.
