, DELTA SAND AND GRAVE~CO. • PAGE 6
MLRB PERMIT p Mme- ~ I CI- , Q Q
ADEQUACY RESPONSE I /
June 12, 1996
with DMEA to move the pole so there would be better access to this property and we
can only assume they knew what they were doing when the pedestal was moved.
~ ~~k
~f,`~~.-. 5) We have not disrupted any of the ditches that cross the property and if a ditch has
I' ~"'~`k ~V~ been properly maintained water will continue to flow as it has historically. See
comments in reference to Mr. Cordovas' attorneys, letter.
/~~ d ~~"^'~)~ All parties that need access to the ditches were offered keys to the new access road
l ,.,,,,~ , ~j ~L~ we constructed this spring, only two of them took us up on the offer. In addition,
(w«u ~ none of the historic access gates or fence openings have been changed from what they
1\ ~vl'~ (~5 were in the past. Not only have gates not been locked, there isn't a gate on one of
the fence opening. The commentors should remember that private property rights are
protected in America and if they wish to vespass on the site they should contract Mr.
Ripp or Delta Sand and Gravel for permission.
C(~ ~~ ~_ 7) We did not know Delta had to have permission from outside parities to use their
(~"""" ~`~n ~ leased property as they see fit, if it is approved by the landowners. Nor are we
aware that Delta can be held responsible for DMEAs actions concerning their
property.
A copy of this response letter, the DM&G Adequacy Review packet and 7-June-96
letter will be placed with the County Clerks office by June 14, 1996. We will forward a
copy of a delivery receipt letter to you when we have it. Mr. Ripp has your file copy of the
DMEA powerline agreement letter that he will send with the County Clerk delivery letter. I
hope these responses are adequate and if you need additional information please call me at
423-7297.
Sincerely,
ENVIRONMENT, INC.
~~
Stevan L. O'Brian
Vice President
ce Delta Sand and Gravel
Montrose County Clerk
file
