It is more likely this ditch will be <br />abandoned since the approved reclamation plan eliminates irrigation practices on the pazcel. <br />We do not believe accumulation of water will occur from seepage in the mined area. <br />The western "seepage pond" is fed by an irrigation waste ditch that crosses that part of the <br />site. Once irrigation stops on our facility, the only water will come from up gradient waste <br />flowing thru this isolated drainage. We also plan to leave from 6 to 10 inches of gravel on <br />top of the underlaying bed rock, over which 12 inches ± of topsoil will be spread. This <br />underlaying gravel will act as a drainage medium so water will continue to flow thru the site <br />and there will not be an accumulation of seepage water in the lower parts of the facility. <br />Exhibit - F Reclamation Plan Mao <br />Thank you for pointing this out, the contour notations have been corrected so they aze <br />structurally correct. As noted earlier this building was removed before the original permit <br />was approved and I failed to leave it off the maps when they were prepared. I discussed the <br />possibility of disturbing this area in the future under the mining plan and Delta understands <br />that if they disturb any part of the old pit that they would have to reclaim it. If they decided <br />to mine the area in the future we will submit the intent to mine notice and revised mining <br />and reclamation plan maps for Division review prior to commencing. I have added some <br />fazm roads to the map but their permanent location is hazd to predict at this time. Roads will <br />be important for access to the reclaimed area, but the locations may vary because farmers <br />tend to drive where it is convenient. <br />Exhibit - L Reclamation Costs <br />I gave prepared an estimate using the 700 feet noted above and using Mr. Dillies' <br />analysis from the 1996 Technical Revision. <br />Additional Items <br />Attached is a packet containing copies of: <br />• the Proof of Publication, <br />• a copy of the first publication <br />• return receipts from the individual delivered notices <br />• a copy of the postal receipts for each notice and <br />• a copy of Carpenters' notice that was not picked up from the post office. <br />TISDEL, HOCKERSMTTH & BURNS, P.C. LETTER <br />AJ Lust The road issue is mote, it is a county problem and Delta has been working with <br />ikS "''°~ Montrose County road department. Mr. Ripp contacted Mr. Cordova last week in an attempt <br />u~/d'~- ~ to discuss his concerns, at this time Mr. Cordova has not called back. Delta Sand and <br />Gravel corrected the problem Friday 7-June-96 and the 12 inch CMP has been reset so water <br />can Flow thN it. It is our understanding that this ditch is only used if Mr. Cordovan' <br />pipeline is inoperative. The ditch is choked with weeds and willows and we estimate it has <br />not been used for 10 years or more. <br />
