<br />Lewicki <br />February 27, 1997 <br />Page 2 of 2 Pages <br />Comment I : The provisions of Rule 4.05.9(1) aze demonstrated in the Revision less a part of <br />4.05.9(1)(a), (e) and (f). <br />With regard to 4.05.9(1)(a), please cite by specific reference or enclosure those water quality <br />analyses [hat demonstrate that discharge water from the impoundment shall meet applicable State <br />and Federal water quality standards (an expansion of the Revision statement "Water quality <br />analysis of this water is enclosed in this section."). <br />With regard to 4.05.9(1)(e)and (f), please provide certified drawings of the pond and the spillway <br />design. The accepted 25-year, 24-hour flow (TR 12) is 189 cubic feet per second. <br />Comment 2: The provisions of Rule 4.16 are demonstrated in the application less 4.16.3(3). The <br />response to 4.05.9(I)(e} and (f) will fulfill this requirement. <br />Comment 3: Please demonstrate notification [o the Corps of Engineers (under their general <br />permit number 21) and to the State Engineer (non-jurisdictional dam) as was done for the upper <br />pond under TR 12 (Rule 4.05.9). <br />Comment 4: Please provide replacement pages and instructions for insertion in the Permit that <br />incorporate the provisions of the Revision. The draft paragraph 4.05.9{1) provided with the <br />submittal indicates that the smaller, lower dam will be reclaimed (removed); however the intent <br />of TR 13 is to retain it. <br />The subject impoundment (and the upper pond) are under the jurisdiction of the CDMG until <br />Phase III release.
