BANTA, Director <br />April 10, 1989 <br />Mr. Bob Sherman <br />Rockcastle Coal Company <br />C/0 Mr. Mark Korb <br />Korb and Carroll <br />106 Oak Street <br />Fort Collins, Colorado 80524 <br />RE: Mid-Tenn Review Bonding Discussion, Grassy Gap Mine, C-81-039 <br />Dear Mr. Korb: <br />I would like to summarize the commitments, timeframes and understandings which <br />arose out of our discussions on April 4, 1989. <br />-The Grassy Gap sign on Twentymile Road will be modified with the <br />P.O. Box Number and the MLRD Permit number within the next six weeks. <br />-Bob Sherman will check with the Valoras about seeding of the west side <br />of the topsoil stockpile at Pit 4. If it was not done in the fall it <br />will be re-done in May. <br />-The upper inflow ditch of Pond 4 will be cleaned of sediment at the site <br />of its breach and the resultant gully will be backfilled and .seeded by <br />the end of June or whenever it dries out, whichever is later. <br />-The quarterly self-inspection of ponds report will be done for the <br />second quarter of 1989, and Mr. Sherman will try to find the one he wrote <br />during the fourth quarter of 1988. These will be sent to the MLRD Denver <br />office as well as Hattie Yeager. <br />-The spoils well at Pit 2 will be examined for integrity and re-capped <br />by the end of June. <br />-A1 Miller will record the location of springs and seeps during the June <br />water sampling, and submit a map documenting locations and approximate <br />flows with the 1989 Annual Hydrology Report. <br />-Pond 005 will be cleaned out and re-surveyed to ensure that it has been <br />cleaned out to its design levels as soon as heavy equipment can be <br />operated at the site. <br />-Rockcastle will decide within two months whether it will proceed with <br />i bond liability release. (I have enclosed information on the bond release, <br />submittal package for your use). If bond release is not requested this / <br />summer, Rockcastle must submit hydraulics calculations for the ditches <br />\ and ponds at Pits 2 and 3 by July 7, 1989 or face enforcement action. <br />215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
