BANTA, Director <br />DATE: December 21, 1988 <br />T0: Mike Savag <br />FROM: Dave Berry <br />RE: Bond Reduction/Bond Release Information <br />CYCC - Mine No. 3 - C-84-082 <br />The following information is provided to summarize the recent bond adjustment <br />and bond release actions pertaining to Mine No. 3. <br />Surface Ownership <br />The entire surface area at Mine No. 3 is privately owned. (References: Map <br />No. 5, Permit Application Page) <br />Coal Ownership <br />Approximately 9 acres of the Mine No. 3 permit area are underlain by federal <br />coal. Specifically, this area is located in the southeast 1/4 of Section 1, <br />Township 5 North Range 85 West. The area was never mined or disturbed, <br />according to the available permit document maps. Additionally, during a <br />telephone conversation on December 21, 1988, Steve Bennett of the B.L.M <br />indicated that the parcel is not now, and apparently never has been, leased <br />for mining. The permit Application Page indicates that the mined coal is 100% <br />privately owned. <br />Phase I Bond-Release <br />A Phase I Bond Release Request, dated February 9, 1987, was received by the <br />Division on February 12, 1987. On June 15, 1987, the Division notified CYCC <br />of an upcoming bond release inspection to be conducted June 24, 1987 through <br />June 26, 1987. The notification indicated that B.L.M. and O.S.M. personnel <br />would accompany our inspectors during the inspection. <br />The inspection did occur on June 25, 1988, and the O.S.M. inspector was <br />Ronald Sassaman. The inspection read, in part, as follows: "Based on this <br />review and the assumption that any remedial work will be completed to MLRD's <br />satisfaction, I believe the partial bond release for backfilling and grading <br />should be granted when MLRD is actually prepared to do so."
