Box 591 <br />Somerset, Colorado 81434 <br />Re: Minor Revision No. 209 (Mine Water Dischazge Pipe in Lone Pine Gulch); West Elk <br />Mine (Permit No. C-80-007) <br />Dear Ms. Johnston: <br />On Mazch O5, 1997 the Division received the above-referenced minor revision application. The <br />application has been deemed incomplete for the purposes of filing for the following reasons: <br />The minor revision did not address any surface ownership issues that may azise from the <br />installation of the proposed mine water dischazge pipe. It is unclear from revised Map <br />54A whether the pipe will impact other surface owners. Please provide a statement <br />indicating whether any portion of the pipe will be installed on any surface owner's <br />property other than Mountain Coal Company (MCC). <br />2. Please revise Map 54A to include township, range, and section information. All future <br />maps submitted as revisions to the permit document should include this information. <br />3. The trace of the pipe is bazely legible on Map 54A, particularly where it discharges to <br />Lone Pine Gulch. Please revise the map to clearly show the discharge location and label <br />it appropriately. <br />4. Outfalls 014 and O15 have been added as discharge points, according to the amendment <br />to the CDPS permit (submitted with MR-209). However, these have not been addressed <br />in the appropriate sections of the permit document. Outfall 013 is only briefly described <br />on revised permit page 2.05-22 submitted with MR-209. All new outfalls should be <br />briefly described in the permit. Please revise the permit document accordingly. <br />5. Additional outfalls and discharge quantities need to be added to [he Probable Hydrologic <br />Consequences portion of the permit. Please revise the permit document accordingly. <br />
