No response is necessary. <br />Part II -Additional Adequacy Continents <br />1. MCC is in the process of updating the SPCC Plan as contained in Exhibit 8 of <br />Volume 2. The updated plan will be submitted [o the Division upon approval by the <br />Colorado Department of Health. <br />2. A technical revision application for the reconfiguration of [he Lower Refuse Pile has <br />been submitted separately. Page 2.053 of the reclamation plan has been updated to <br />include the approved variance of cover on the refuse pile. See attached revised page. <br />3. Page 2.05-33 has been revised to indicate that the Freshwater Pond (FW-2) is not <br />planned to be constructed during this permit term. <br />4. Portions of the Bear Coal Company reclamation plan which refer to the MCC's old <br />Bear Mine site have been included as new Exhibit 64. <br />5. As-built designs for sediment ponds, freshwater pond, and ditches are currently being <br />completed and will be submitted to the Division by December 30, 1992. <br />6. Page 2.05-28 has been revised to include a statement regarding sediment control at <br />drill sites within the permit area. See attached revised page. <br />Part III -Stipulations <br />As indicated in the August 26, 1992 letter, no response is necessary at this time. <br />2. The information contained on Page 3-79 of the old permit document has been <br />incorporated on Page 2.05-147 of the new document (see attached revised page). <br />MCC requests that this stipulation be terminated. <br />3. The requested change has been made to Page 2.05-39 of the per[[[il document (see <br />attached revised page). MCC requests that this stipulation be terminated. <br />4. As indicated in the August 26, 1992 letter, this stipulation has been resolved. <br />
