<br />Adequacy Review 3 August 28, 1998 <br />Amendment Application AM-01 <br />Tozer Pit Permit No. M-78-107 <br />Permanent Man-Made Structures: The pre-existing access road, referenced above under <br />"Roads", is a permanent man-made structure. Pursuant to Rule 6.4.19, please ensure that <br />the pre-existing access road is listed under Exhibit S. Additionally, please provide a <br />notarized damage compensation agreement OR appropriate engineering evaluation for the <br />pre-existing access road, as required by Rule 6.4.191a) and (b). <br />Exhibit S of the application, lists County Road G and Empire Electric power line, as <br />permanent man-made structures located within 200' of affected lands. Please provide a <br />notarized damage compensation agreement OR appropriate engineering evaluation, for all <br />structures located within 200' of affected lands, as required by Rule 6.4.19(a) and Ib). <br />Hydrologic Balance: The soils information, submitted within the application, indicate <br />severe water erosion potential. NRCS letter, dated 5/22/98, indicates potential for <br />intermittent flooding, especially in Phase VII. The application indicates that affected area <br />drainage will be controlled with sediment containment berms and treated for sediment, <br />prior to leaving the permit area, with straw bale filters and sediment ponds. <br />Details of the sediment containment berms, provided on the Reclamation Plan Map, <br />indicate a bottom width of 2' and height of 3'. Such details indicate a berm outslope of <br />0.33H:1 V (300%). DMG cannot approve such designs in the absence of an engineering <br />demonstration indicating that the such berms will remain stable. Please provide an <br />engineering demonstration showing stable 300% slopes, OR correct the apparent error in <br />the indicated berm design. DMG recommends a maximum slope of 3H:1 V for earthen <br />berms, stabilized with riprap or vegetative cover. <br />The Mine and Reclamation Plans and Maps indicate that three sediment ponds will be <br />constructed. However, description of the ponds construction, size, capacity and discharge <br />structures are absent. Given the severe erosion potential of the soils and potential for <br />intermittent flooding, please provide construction details for the proposed ponds, which <br />demonstrate compliance with Rule 3.1.6. <br />Reclamation Plan: Exhibit E--Reclamation Plan, indicates that topsoil and overburden will <br />be salvaged for reclamation purposes, but not segregated as required by Rule 3.1.9(1). <br />Please correct the wording of the Reclamation Plan to indicate compliance with the <br />conditions of Rule 3.1.911). Additionally, the application does not commit to a <br />replacement depth of topsoil, as indicated by Rules 6.4.511) and (2)(f)(v). Please include a <br />minimum depth or range of depths for topsoil replacement. <br />Exhibit E also indicates that revegetation efforts will occur in accordance with NRCS <br />recommendations and suggests that additional fortis and shrub seeds will be added, <br />beyond the NRCS recommended seed mix. Pursuant to Rules 6.4.512)(d) and If)(iv), please <br />list all species to be planted and seed rates. Please include a nitrogen fixing legume seed <br />in the seed mix, as indicated by Rule 3.1.1011) and 14) and 6.4.512)(d). <br />
