Pauline Street, No. 9 <br />Anaheim, California 92805 <br />RE: Post-Mining Land Use Change at the Trinidad Basin Mine <br />(Our File No. C-81-048, TR - OS) <br />Dear Mr. & Mrs. Tohn: <br />This letter is written to notify you of a proposed decision by the Colorado <br />Mined Land Reclamation Division (the Division) to approve a request to change <br />the post-mining land use from rangeland/wildlife to residential on the western <br />half of the Trinidad Basin Mine. The land subject to the proposed land use <br />change includes the west 1/2 of section 15 and the west 1/2 of section 22, <br />T31S, R65W of the 6th P.M. in Las Animas County, Colorado. More specifically <br />the areas involved include portions of lots 32, 33, 34, 35, 36, 38, 39 and 64 <br />of the Del Agua Canyon Ranches. <br />This decision complies with the Colorado Mined Land Reclamation Board Rules <br />for Coal Mining. Specifically, the decision is based in part on Rule 4.16.3, <br />Alternative Land Use. Two sections of this rule which pertain directly to <br />this change include determinations by the Division that: <br />4.16.3(1) The proposed post-mining land use i <br />land use and, where applicable, wit <br />federal land use policies and plans <br />including any necessary zoning or o <br />land by local, state or federal lan <br />shall be obtained and remain valid <br />coal mining operations. <br />s compatible with adjacent <br />h existing local, state or <br />any required approval, <br />they changes required for <br />d management agencies, <br />throughout the surface <br />4.16.3(3) The proposed use will not present actual or probable hazard <br />to public health or safety nor will it pose actual or <br />probable threat of water flow diminution or pollution <br />contrary to state or federal laws, rules or regulations. <br />
