C. Light Use Roads -Rule 4.03.3. Light use roads, some of which were pre-mining trails, <br />are used infrequently to monitor sedimentation ponds or other facilities. These roads meet the <br />design requirements of the Rules. Some light use roads will be retained (reclamation) as "ranch <br />roads" to approximate roads that were in the area before mining (Permit, page 2.05-61). <br />D. In-Pit Haul Roads. As presented in Rule 1.04((11), the definition of "road" does not <br />include roadways within the immediate mining pit azea. <br />11. Support Facilities -Rule 4.04 <br />The Permit is found to be in compliance with the requirements of Rule 4.04. Information on <br />mine support facilities is found in Section 4.04 of the Permit. The Division finds that support <br />facilities aze designed, constructed, maintained, and their planned demolition and (area) <br />reclamation is sufficient to: prevent damage to fish, wildlife, and related environmental damages <br />and prevent additional contributions of suspended solids to streamflow or runoff outside the <br />permit azea [Rule 4.04(1)]; control and minimize diminution or degradation of water quality and <br />quantity [Rule 4.04(2)]; control and minimize erosion and siltation [Rule 4.04(3)]; control and <br />minimize air pollution [Rule 4.04(4)]; prevent damage to public or private property [Rule <br />4.04(5)]; and minimize damage, destruction, or disruption of services provided by oil, gas, water <br />wells; oil, gas, and coal slurry pipelines; railroads, electric and telephone lines; water and sewage <br />lines which pass over, under, or through the permit area, unless otherwise approved by the owner <br />of those facilities and the Division [Rule 4.04(6)]. <br />III. Hydrologic Balance -Rule 4.05 <br />The Permit is found to be, with an approved partial exception [see paragraph G(2)(K) below], in <br />compliance with the requirements of Rule 4.05. <br />33 Revised Oc[ober 30, 1997 <br />
