Rule 2.07.6(2)(n)]. (See Letters, 28 July 1997 and July 29, 1997, United States Department of
the Interior, Bureau of Land Management, as Attachments 5 and 6, also found in Exhibit ] 0 of
the Permit.)
L. Fees. The Division has contacted the Office of Surface Mining, Reclamation Fees
Branch. As of July 7, 1997, the operator is current in the payment of reclamation fees required
by 30 CFR Chapter VII, subchapter R. [In compliance with Rule 2.07.6(2)(0).]
SECTION B -Findings and Specific Approvals Required by Rule A
I. Roads -Rule 4.03
The Permit is found to be in compliance with the requirements of Rule 4.03. Information on
roads is presented on pages 2.05-20 through 2.05-21, Section 4.03, and Map 25 of the Permit.
Three types of roads are described in the Permit: haul roads, an access road that has been
redesignated as a haul road, and light-use roads.
A. Haul Roads -Rule 4.03.1. The main haul road (Haul Road A), which runs approximately
four miles from the active pit area to the secondary crusher at the loadout, has been paved with
asphalt (Permit, page 4.03-1). Haul Road B was once designated as the Access Road (Permit,
page 4.03-1). This Haul Road B is an asphalt paved road from State Highway 13 to the main
haul road. The Mine administrative office building is located along this Haul Road B. Both haul
roads meet all design and construction requirements of the haul road regulations. The
reclamation plan calls for the removal of the pavement, reduction of the road width to l2 feet,
reduction of side slopes to 4:1 and revegetation of the sideslopes for Haul Road B [Permit, page
2.05-61; Rule 4.03.1(1)(f)(ii)]. Haul Road A is to be removed and reclaimed.
B. Access Road -Rule 4.03.2. With the redesignation of the road from State Highway 13 to
the main haul road as a haul road, no road is currently designated as an access road.
32 Revised October 30, 1997
