II. Feasibility. Based on information contained in the permit application and other <br />information available to the Division, the Division finds that surface coal mining and reclamation <br />can be feasibly accomplished at the Colowyo Mine [in compliance with Rule 2.07.6(2)(6)] <br />III. Cumulative Impacts. The assessment of the probable cumulative impacts of all <br />anticipated coal mining in the general azea on the hydrologic balance, as described in Rule <br />?.05.6(3), has been made by the Division. This assessment, entitled "Yampa River Cumulative <br />Hydrologic Impact Statement," is available for inspection at the offices of the Division. The <br />Division finds that the operations proposed under the application have been designed to prevent <br />damage to the hydrologic balance outside the proposed permit area [in compliance with Rule <br />2.07.6(2)(c)]. See Section B. III (Probable Hydrologic Consequences) of this document for <br />additional discussion of the predicted hydrologic consequences of mining operations at the <br />Colowyo Coal Mine. <br />IV. Unsuitable Areas. The Division finds the affected azea is, subject to valid rights existing <br />as of August 3, 1977, and with the further exception of those surface coal mining operations <br />which were in existence on August 3, 1997, as described in the following subpazagraphs. <br />A. Areas Designated Unsuitable. The Permit area is not included within an area designated <br />unsuitable for surface coal mining operations [incompliance with Rule 2.07.6(2)(d)(I)]. <br />B. Under Study. The Permit area is not included within an area under study for designation <br />as unsuitable for surface coal mining operations [in compliance with Rule 2.07.6(2)(d)(ii)]. <br />C. Prohibitions and Limitations. The affected area is not on any lands subject to the <br />following prohibitions or limitations: <br />1.
