The Division has the following <br />concerns which should be resolved prior to issuance of the proposed decision. <br />In regards to the comments supplied by the Division of Water Resources, the <br />Division of Minerals & Geology (DMG) will stipulate that the Division 4 Water <br />Court be notified of the new pond locations within 45 days of DMG's proposed <br />decision. The second part of this stipulation will require that a dam safety <br />review be completed on MB-2 and MB-3 within 45 after construction of the ponds <br />is completed. <br />This letter addressee all previous Division concerns with the exception of the <br />hydrology related concerns, which we are still awaiting. Further Division <br />response regarding the subsurface investigation will be included with the <br />hydrology responses. <br />MISCF.r.T.nrrr•OUS <br />1. The Division believes that drawing G-104 should be included in Exhibit 66. <br />In addition, the Division believes that drawings G-101 and G-102 should be <br />incorporated into the permit. <br />4. If materials are to be stored temporarily on the refuse pile, they should <br />be placed so ae not to preclude reclamation or compaction activities. <br />ROADS <br />1. The changes made to page 2.05-22 are acceptable to the Division. No <br />further response is required. <br />3. The update of Table 47, to include topsoil removed during the ponds and <br />road construction, should be included when MCC addressee Stipulation No. <br />49. <br />4. This is acceptable to the Division. No further response ie required. <br />BOND ESTIMATE <br />1. Unit costa have been adjusted to the satisfaction of the Division; <br />therefore, no further response is required. <br />
