Approval to increase the height of the 'I <br />Phase II toe berm an additional two feet will result in an overall raise of seven feet during the 1999 <br />construction season. <br />The increased height of the toe berm will provide two additional feet of freeboard under die <br />approved operating scenario. This proposed increase in the toe berm height is not related to the <br />water balance prepared for Amendment No. 7, as indicated during our meeting with representatives <br />of the Division of Minerals and Geology, Office of Mined Land Reclamation ("OMLR") on March <br />5, 1999. CC&V does not propose at this time to change any of the operational parameters <br />associated with the Phase I or Phase II pregnant solution storage areas or any other aspect of <br />managing the VLF, due to the increased height of the toe berm. <br />As discussed during our meeting, the Phase II toe berm is an important element in the stability of <br />the VLF, since it functions as a buttress for one of the stability modes analyzed in Amendment No. <br />7 (see Volume II, Section 5.1.3, page 38). Increasing the height and mass of the Phase II toe berm <br />would only serve to further buttress the ore along the referenced Phase I[ toe berm stability section <br />presented in Amendment No. 7. ~ <br />~' ~n , <br /> <br /> <br />
