is not intended to change the schedule from weekly to monthly.
Depletions resulting from pumping in any week shall be added to the
depletion schedule and replacements for such Bumping shall begin
the following week.
2. Precipitation Run-Off and Evaporation Repla<ement.
(a) In addition to the augmentation requirements set forth in
paragraph 1, Applicant shall deliver water to the Rito Seco to
augment depletions associated with the impoundment of rainfall and
snowfall in the areas known as the tailings impoundment area, the
east ore zone and the west ore zone. The quantity of augmentation
water to be delivered to the Rito Seco to augment these depletions
shall be determined by utilization of data collected from the
precipitation recording gauge as described in subparagraphs (c) and
(d) hereof. During Applicant's dewaterinq activities, Applicant
shall not be required to augment depletions associated with the
impoundment of precipitation in any area that is then being
dewatered. Augmentation for snowfall runoff may be delayed as
determined in consultation with the Division Engineer.
(b) In addition to the augmentation requirements set forth in
paragraphs 1 and 2 (aj hereof, if the groundwater level adjacent to
the pits is not below the pit floors, and a seepage face develops
'i along the pit walls, augmentation of evaporative lasses from the
seepage face shall be required. Replacement water requirements
shall be calculated weekly from groundwater levels established from
the nearest observation well, evaporation pan data (see
subparagraph (c) hereof), and estimated area of the seepage face,
,;'~ and Applicant shall deliver water to the Rito Seco to augment the
depletions.
(c) Applicant shall install and maintain at its expense a
continuously recording precipitation gauging station and a NOAA
approved evaporation pan to measure evaporative losses. The
devices will be installed within the immediate area of the plant
site in a manner that meets NOAA criteria for site selection and
data recording. The station will continuously record the amount of
water associated with rainfall and snowfall.
(d) The tailings impoundment area until reclaimed impounds
water from an area which may be as large as 204 acres, the west ore
zone area will impound water from an area that may crwer as much as
il0 acres, and the east ore zone area will impound water from an
area that may cover as mush as 20 acres. The above acreage numbers
are estimates and. the replacement obligation shall be based upon
the actual acreage that is impounded. For the purpose of
establishing the depletions in each of these impoundment areas, it
will be assumed that precipitation measured at the gauge has fallen
uniformly within the total acreage in each impoundment area. For
the months of November through April, 50~ of the estimated average
monthly precipitation at the project site (which the parties agree
