<br />water to the Rito Seco as set forth herein so that there will be no <br />injury to other water users. <br />G. Opposer is willing not to oppose the entry of a decree <br />provided that it conforms to the provisions of this Stipulation and <br />existing Stipulations with other Opposers. <br />NOW THEREFORE IT IS AGREED between Applicant and Opposer that <br />any decree granted herein shall be subject to the following <br />provisions and limitations: <br />1. (a) The quantity of augmentation water to be delivered to <br />the Rito Seco to augment depletions associated with the dewatering <br />activities shall be based upon the "Analytical Stream Depletion <br />Model" prepared by the Colorado Division of Water Resources and <br />commonly referred to as the Glover Model. The Glower Model is a <br />way of calculating the effect of a well or other groundwater <br />dewatering operation on a nearby stream, which has been generally <br />accepted by the Colorado water courts. It assumes that eventually <br />all of the water so withdrawn will be a depletion to the stream, <br />and so conforms to the assumption stated in paragraph 27 of <br />Applicant's proposed Decree sent to counsel on November 20, 1990, <br />identified as rv6. Reasonable parameters for the Glover <br />calculation are as follows: <br />Transmissivity, T = 2,150 gallons per day per foot, storage <br />coefficient S = 0.15, distance from stream d = 750 feet, half- <br />width of aquifer (distance to mathematical no flow boundary) <br />2,000 feet and an infinite length of stream contact. <br />These parameters are reasonable and supported by the evidence. In <br />order to provide useable amounts of water instead of the minimal <br />deliveries which would otherwise be calculated try the Glover <br />program for the period greater than four years after pumping, the <br />parties agree to concentrate subsequent delivery obligations so <br />that the aggregate replacement obligation for any month of pumping <br />shall be as shown in the attached table. The attached table and <br />other provisions of this paragraph are subject to approval by the <br />State and such approval shall be sought by all parties hereto. <br />(b) An accounting system shall be maintained by Applicant, <br />using the attached table, to which the amount of water withdrawn <br />from the ore zones shall be updated weekly, to calculate stream <br />depletions. Such quantities shall be reported to the Division <br />Engineer as provided in paragraph 15(c) of Applicant's proposed <br />Decree sent to counsel on November 20, 1990 identified as rv6. By <br />way of example (and not by way of limiting the flexibility of. the <br />Applicant's dewatering schedule) the table attached hereto shows <br />the amounts of water to be replaced in months following the month <br />in which dewatering occurs, as a percentage of amoumt dewatered in <br />that month, to show the operation of the Glover method.
