Our investigation was conducted October 25, 1994. The reason for our investigation <br />was notification by Mr. Randy Booco, caretaker for Sun Coal, through Mr. Bryan Archer, that <br />John Silts had driven his Caterpillar bulldozer across his and Grassy Creek Coal Company <br />property, causing disturbance to these fully reclaimed and revegetated areas. This disturbance <br />occurred during the second week of October. Mr. Silts is not and was not authorized to <br />operate on the reclaimed areas. Mr. Silts does not operate under the direction of Sun Coal <br />Company or under the direction of any of Sun Coal's authorized subcontractors. <br />On October 25, 1994, I followed the Caterpillar tracks, originating on the road adjacent to the <br />reclaimed pit area on the west side (please see attached sketch map). Mr. Silts drove the dozer <br />down the reclaimed road above the sediment ponds to a point above the upper impoundment. <br />He then proceeded down the slope, across the swale bottom and up the west facing slope to <br />access the bench area. The dozer was then driven across the bench area, paralleling the fence <br />dividing the reclaimed bench azea from the reclaimed topsoil stockpile area and undisturbed <br />azea. He then proceeded through an opening in the fence, up the reclaimed slope, across the <br />reclaimed topsoil pile area, through undisturbed sagebrush to the permit azea fence line on the <br />southeast. There being no gate, the dozer was turned 180° and driven back down the slope. <br />At this point the dozer proceeded north, skirting an oakbrush clump and along a reclaimed <br />road to a gate above the southeast diversion ditch. The dozer was driven through the gate and <br />up the reclaimed access road and fenceline on the southeast side of the reclaimed area. At the <br />top of the slope the dozer was driven along what appeazed to be a former ranch road, and <br />across a flat reclaimed area (presumably for old oil or gas exploration). These areas aze <br />outside Sun Coal's reclaimed azea. At some point the dozer returned, but separate tracks were <br />not identified on the Meadows No. 1 reclaimed area. Dozer tracks were found along the road <br />outside the permit azea to the southeast of the lower sediment pond. <br />
