In <br />4 addition, they filed an application to adjudicate <br />5 nontributary groundwater located beneath the land <br />6 that they own. <br />7 Both of those are currently pending in <br />8 the State Engineer's Office and the Division 3 Water <br />9 Court in ALamosa. <br />10 Water monitoring for this project will <br />11 be very similar to what was approved in the original <br />12 application with the exception of reevaluation of <br />13 water monitoring in the area of the tailings <br />14 facility. <br />15 Battle Mountain Gold has placed four <br />16 additional wells in the area of the tailings <br />17 facility. For those four additional wells, as well <br />18 as other wells and surface water monitoring in the <br />19 area of the tailings facility, they will comply with <br />20 the stipulation placed on the approved permit. That <br />21 stipulation required monthly monitoring of ground <br />22 and surface water in the vicinity of the heap leach <br />23 and quarterly reporting to the Mined Land <br />24 Reclamation Division.
