Please follow theinsttvcliousprovidedinthis <br />package for tiling an application; Mirternl Rules and Regulations and Constnution Material Rules and Regulations Number 1.12 <br />(Permit Transfer application requirements) should also be reviewed prior ra completing this fbmt. <br />F11in¢ Requirements <br />To apply for a transfer please submit the following to the Division of Reclamation, Mining and Safety (the Division): <br />i) A "'Trnsfer of Permit and Succession of Operator" application form, signed and notarized by an autharizexi <br />representafive of B_ 1~7{ the current permittee and successar oparatoG <br />2 The A licalion Fee of $100.00 for Hard Rock u rations and $1 00 for ns etion Mate 'also erations; <br />PP Pe u ;~ ~ uk 7/t'~~ P <br />3) A Performance Warranty Form bearing an original notarized signature of an authorized representative of the successor <br />operator; and, <br />4) Financial Warranty: <br />A) You have the option to W AIV F, YOUR RIGHT to a thirty (30) day processing time to allow the Division time <br />to recalculate the required financial warranty; or, <br />B) You may choose N01"TO WAIVE YOUR RICiH'I' to a thirty (30) day processing time, to such case, the <br />Division will recalculate the required financial warrnntywithin sixty (60) days from the decision date (the date <br />the permit is transferred to the Successor Operator). If the financial warranty is increased, you will then he required <br />to post the additional financial warranty. <br />'17tis application package contains the ""Transfer of Permit and Succession of Operator" application form, and a Performance <br />~Varran[y form for your use. Rule 43 of the Mineral Rules and Regulations and Rule 4.3 of the Construction Material Rules and <br />Regulations describes the various acceptable Finaucial Warranty types. Please contact the Division to obtain the appropriate <br />Financial Warranty form, <br />Upon submittal of this application, the application fee, and the replacement pertbmtanee and fmancial warranties the Division will <br />transfer the permit to the Successor Operator AIler Ote transfer is complete the llivision will then review the reclamation costs of <br />the permitttd operation.
