To apply for a transfer please submit the following to the Division of Reclamation, Mining and Safety (the Division):
i) A "'Trnsfer of Permit and Succession of Operator" application form, signed and notarized by an autharizexi

3) A Performance Warranty Form bearing an original notarized signature of an authorized representative of the successor
operator; and,
4) Financial Warranty:
A) You have the option to W AIV F, YOUR RIGHT to a thirty (30) day processing time to allow the Division time
to recalculate the required financial warranty; or,
B) You may choose N01"TO WAIVE YOUR RICiH'I' to a thirty (30) day processing time, to such case, the
Division will recalculate the required financial warrnntywithin sixty (60) days from the decision date (the date
the permit is transferred to the Successor Operator). 'The required R1iCl.AMA'I'ION BOND COULD BE

to post the additional financial warranty.
'17tis application package contains the ""Transfer of Permit and Succession of Operator" application form, and a Performance
~Varran[y form for your use. Rule 43 of the Mineral Rules and Regulations and Rule 4.3 of the Construction Material Rules and
Regulations describes the various acceptable Finaucial Warranty types. Please contact the Division to obtain the appropriate
Financial Warranty form,
Upon submittal of this application, the application fee, and the replacement pertbmtanee and fmancial warranties the Division will
transfer the permit to the Successor Operator AIler Ote transfer is complete the llivision will then review the reclamation costs of
the permitttd operation. The Successor Operator will be notified, if additional reclamation bond is required, within GO days of
approval ifyou do not wave your right to a decision within 30 days. 97te Division will notify both operators upon completion ofthe
permit transfer.
