Preliminary Adequacy Review.
Dear Mr. Moores.
1 have reviewed the materials You have submitted for the above-named amendment, and have a few questions
which need to be answered before the decision date. The amendment was found complete on December 26, 2000,
and the decision date is therefore set for Januaq~ 2~. 2001. Please be reminded that you must publish a notice in the
local newspaper, according to the Divisions December 26, 2000, letter to you. Please ensure that this is done
promptly, since the 10-day public comment period following publication must be finished before a decision on [he
application can be made.
My comments and questions are listed in the following paragraphs, and arranged iu [he order of [he application item
or exhibit to which they pertain. Please arrange your responses in the same order t0 facilitate their review.
Application Item 3 -Permitted Acrea¢e
The map you submitted prior to this amendment application, received by the Division on July 17, 2000, and to
which you refer in this application, was originally reviewed in the context of an acreage release request (AR-01).
That release request was later wi[hdraWn, but not until after the map itself was reviewed. My letter to yrou, dated
August 7, 2000, pointed out numerous differences in the boundary lines mld the acreages, between the new (2000)
vs. old (1996) slaps. My questions in that letter were never answered, vld there may still exist several questions
about the small differences in the documented amounts of acreage presently permitted and proposed to be added.
Since you appear to base some of [he proposed boundaries ou this map in question, some of those issues may still
be pertinent. I will explore some of [hose questions under Exhibit E, beloly.
Aside from the acreage questions referred to above, there is an apparent geographical error in this item: the
existing permitted acreage plus added acreage do not equal the total acreage shown. Please submit the correct
acreages on a revised t?ont page for [he application.
Exhibit C - Minin¢ Plan
You propose to continue to screen and cnlsh material, almualh~ or as needed, and occasionally batch asphalt at the
site. Please state where such operations are expected [o occur. Thz location of such equipment and/or [he storage
of filets and fluids, especially in close proximity [o irrigation seepage. is ml important factor to evaluate. Also, do
you expect to store waste asphalt from onsi[e botching and/or [o import waste asphalt from offsrte'? Please provide
the requested information.
Please state lvhere topsoil to be used for reclamation well be stockpiled Also, phase describe the method you plan
to use to protect the topsoil from erosion while it is stockpiled.
