Please foitow the instructions provided 1n this <br />package for filing an application; Mineral Rutes and Aegulations Number 1.7 (Permit <br />Transfer aDpllCatlon requirements) shoultl also be reviewed Dr1or to completing this fore <br />Fillna Reauireleents <br />To aDD1Y for a transfer please submit the following to the Division: <br />1) A •Transfer of permit and Succession of Operator" application form, stoned and <br />notarized by 807N the current permittee and successor operator; <br />2) The Application Fee of 6100.00; <br />3> A Performance sarranty Form bearing an orlginat notarized signature of the <br />:successor operator; and, <br />a) Financial Narranty: <br />A) Yau have the option to NAIVE YOUR RIGHT to a thirty (30) day processing time <br />to allow the Division time to recalculate the required financial warranty; or <br />B) You may choose NOT 70 NAIVE YOUR RIGHT to a thirty C30) day processing time. <br />In such case, the Division will recalculate the required financial warranty <br />within sixty (60) days from the decision date. ThB required RECLAMATION BONG <br />COULD BE SUBSTANTIALLY INCREASED at that time. If the financta warranty is <br />increased, you wt11 then be required to post the additional financial <br />rarranty. <br />This application package contains the "Transfer of Permit and Sueeesslon of Operator" <br />application form, and a Performance Narranty form for your use. Rule 7.4 of the Mineral <br />Rules and Regulations describes the var?OUS acceptable Financial Narranty types. Please <br />contact the Division to obtain the appropriate financial Narranty form. <br />Upon submittal of this aDpitcatlon, th• appltcatton fee. and the replacement performance <br />a„d flnartctaf rarranties the Division of Minerals and Geology (tn• "Division"> wi11 <br />tauter the reclamation costs of the permitted aperatton. The Successor Operator must <br />post a nex bond prior to approval of the permit transfer. The Successor Operator w111 <br />be notified 1f adtlltlonal rectamation bond is required within 60 days of approval if yol <br />do not rave your right to a decision within 30 days. TAe Dlvisiort will notify bpih <br />operators upon caepletion of the Derellt transfer. <br />
